Privacy Policy
This policy explains how Consumer Reclaim Ltd, trading as Car Claims Check, uses your personal data. It covers this website, our claim form and the claims we handle for you. It tells you what we collect and where it comes from. It also explains why we use it, who we share it with, how long we keep it and your rights.
In short
- We use your details to check your car finance and, if you sign with us, to run your claim.
- If you opened our page from a text message, some details may already be filled in. Section 4 explains where they came from.
- We share your details with those who need them for your claim. That includes the company that checks your identity and runs the soft credit search, the firms that may assess and progress your claim, our service providers, and regulators when the law requires it. Section 7 names them.
- This website uses only the cookies and storage it needs to work. Our claim form also runs a device check that helps prevent fraud. We do not use analytics or advertising cookies.
- You can ask to see, correct or delete your data, and you can object to how we use it. Email [email protected].
1. Who we are
Car Claims Check is a trading name of Consumer Reclaim Ltd, a claims management company. In this policy, “we”, “us” and “our” mean Consumer Reclaim Ltd.
- Consumer Reclaim Ltd is authorised and regulated by the Financial Conduct Authority (FCA) for regulated claims management activity. Our firm reference number is 835212. You can check this on the Financial Services Register at register.fca.org.uk.
- We are registered in England and Wales, company number 07223077.
- Registered office: 207 Knutsford Road, Grappenhall, Warrington, Cheshire, WA4 2QL.
- Trading address (please send post here): Station House, Stamford New Road, Altrincham, WA14 1EP.
- We are registered with the Information Commissioner’s Office (ICO), registration number ZA176000.
- Email: [email protected].
We are the controller of your personal data. This means we decide why and how it is used, and we are responsible for it. These laws apply:
- the UK General Data Protection Regulation (UK GDPR);
- the Data Protection Act 2018;
- the Privacy and Electronic Communications Regulations 2003 (PECR).
All three were amended by the Data (Use and Access) Act 2025.
A technology company builds and runs this website for us, including its email inbox and the system that reads links from text messages. It acts only on our instructions, as our processor. It may not use your data for its own purposes.
2. The personal data we collect
When you use our claim form
- Your title, first name, last name and date of birth.
- Your mobile number and email address.
- Your current address, including any flat number.
- Your answer, if you choose to give one, to whether you need extra support because of your health, a disability or your circumstances.
- Your answers to the questions FCA rules require us to ask before you sign: whether you still owe money to a lender you have had car finance with, and whether you have ever been bankrupt, subject to a bankruptcy petition, an individual voluntary arrangement (IVA), a debt relief order or a similar process.
- Your confirmation of our statement that you could make your claim yourself, for free; your reason for using a claims management company; and the name you type to sign that statement.
- Your on-screen signature, and your answer to the box about sharing your details with the firms named in section 7.
- Evidence that the signature is yours. This is the date and time you signed, your IP address, and details of your device and browser. Those details are the type of device, the browser and operating system, the screen size, the language setting and the time zone. We also record a short code worked out from those details.
- The result of the identity check and soft credit search that runs after you sign (see section 7), and any one-time code you type in to confirm who you are.
- A session code for the device check that runs on our claim form (see section 7 and our Cookie Policy).
- How you reached the form: from our website, or from a link in a text message. For a text-message link, we record the code in that link.
If you start the form but do not sign and send it, the details you typed are not saved. The device check described in section 7 runs once you start the form, whether or not you send it.
We need the details our form marks as required to check your agreements and make a claim for you. Without them, we cannot take on your claim.
While we handle your claim
- Details of your car finance agreements, and information about your claim and how it is progressing.
- Your emails, letters and other messages with us.
- Recordings of any phone calls between you and us. We record and monitor our calls, as our Terms explain.
- Anything you tell us about needing extra support.
When you visit this website or email us
- Technical details: your IP address, the type of browser and device you use, the pages you visit, and the date and time.
- The choice you make in our cookie banner. See our Cookie Policy.
- If you email us: your email address, your message and any attachments.
3. How and why we use your data

| Keep a record of your signature, the signing evidence and the version of the terms you agreed to. | Performing our contract with you. Our legal duty to keep records under FCA rules (Article 6(1)(c)). Our legitimate interest in being able to show what was agreed and that the signature is yours (Article 6(1)(f)). |

Record those answers, your confirmation that you know you could claim for free, and your reason for using us. | Our legal duty under FCA rules (CMCOB 4.3.1R) to ask these questions and record the answers (Article 6(1)(c)). Performing our contract with you (Article 6(1)(b)). |
| Check your identity, confirm that you are in the UK, and run a soft credit search to find your car finance agreements, after you sign (see section 7). | Your consent (Article 6(1)(a)), which you give when you sign: the declaration you sign says the search will be made. You can withdraw it at any time by contacting Viewthru or by emailing [email protected]. Searches already made are not affected. |
| Send your claim details, your signature and the signing evidence to Consumer Reclaim Ltd’s own claims management system, which runs the identity check and soft credit search (see section 7). | Performing our contract with you (Article 6(1)(b)). |
| Where appropriate, share your information and details of any relevant motor finance agreements with the firms named in section 7, so that your enquiry or potential claim can be assessed and progressed. | Our legitimate interests, and yours, in having your claim assessed and progressed (Article 6(1)(f)). |
| Run a device check on our claim form, to help prevent fraud, including identity fraud (see section 7). | Our legitimate interest, and that of the companies that check your identity, in preventing fraud and in protecting you from it (Article 6(1)(f)). |
| Keep you updated about your claim by email, text message, phone or post. | Performing our contract with you (Article 6(1)(b)). |
| Record and monitor phone calls with you. | Our legal and regulatory duties (Article 6(1)(c)). Our legitimate interest in checking the quality of our service and in having a record of what was said (Article 6(1)(f)). |

| Support you if you tell us you need extra help. | Performing our contract with you. For health information, also your explicit consent (see section 5). |
| Keep this website secure. Prevent fraud and misuse, including misuse of text-message links and of the address finder. | Our legitimate interest in protecting you, our business and this website (Article 6(1)(f)). |
| Meet our legal and regulatory duties. This includes keeping records, handling complaints, answering requests about your data, and dealing with regulators. | Our legal duties (Article 6(1)(c)). |

| Tell you about similar services, where the law allows it (see section 10). | Our legitimate interest in telling clients about similar services (Article 6(1)(f)), or your consent where the law requires it (Article 6(1)(a)). |
Where we rely on legitimate interests, we have weighed them against your rights and interests. You can ask us how we did this, and you can object (see section 11).
4. Where your data comes from
- From you, when you fill in our form, email us, write to us or speak to us.
- From your lenders and car finance brokers, when we use the authority you sign to ask them about your agreements. This can include making a subject access request to them for you.
- From the identity check and soft credit search that runs after you sign. Section 7 explains who runs it.
- Automatically, when you use this website, including the device check on our claim form (see section 2, section 7 and our Cookie Policy).
- From the organisation that sent you a text message, if you opened our page from a link in it. This is explained below.
If you opened our page from a link in a text message
Some of your details may already be filled in on the page, for you to check and correct. These can be your title, name, date of birth, mobile number, email address and postal address. Only the details the sender holds are filled in.
Where the details come from. The text message, and the details filled in on the page, came from the organisation that sent you the text message, which already held your contact details. You can ask us which organisation that was, and where it got your details, by emailing [email protected].
How the link works. Your link contains a code, not your details, so your details never appear in the web address. When you open the link, our server uses the code to fetch your details from the system that sent the message. It then places them in the page. The page is set so that your browser and Cloudflare do not store a copy. The system that sent the message records that your link was opened.
What we keep. We do not keep these details unless you check them and sign. If you do not sign, nothing shown on the page is added to our records.
If your claim goes ahead. We tell the system that sent the message whether a claim was made from your link and whether it was accepted. We send only the link code, our claim reference, the result, and the date and time.
Please do not forward your link. Anyone who opens it can see the details it contains.
If you do not want any more text messages, follow the opt-out instruction in the message. You can also email [email protected] and we will pass your request to the sender. You can object to our use of these details at any time (see section 11).
5. Health and other sensitive information
Our form asks whether you need extra support because of your health, a disability or your circumstances. You do not have to answer. You can also tell us at any time while we handle your claim.
Information about your health or a disability is “special category” data, which the law protects more strictly. We use it only to support you and to adjust how we deal with you. We share it only with people who need it to support you.
We rely on your explicit consent to use this information (UK GDPR Article 9(2)(a)). Where needed, we also rely on the condition for establishing, exercising or defending legal claims (Article 9(2)(f)). You can withdraw your consent at any time by emailing [email protected].
We do not ask for any other special category data.
6. Decisions made by computer
We do not make decisions about you based solely on automated processing, including profiling, that have a legal or similarly significant effect on you.
Our form does check some details automatically. It checks that you are 18 or over, that the required details are filled in and that you have signed. If a check fails, the form tells you, so you can correct it or contact us.
The identity check that runs after you sign is automatic too. If it cannot confirm who you are, or asks for a one-time code that is not entered, your claim cannot go ahead through our form. You can email [email protected] and we will explain your options.
7. Who we share your data with
We share your personal data only where we need to, and only the data that is needed.
Consumer Reclaim Ltd and its claims management system
After you sign, our form sends your details, your signature and the signing evidence securely to Consumer Reclaim Ltd’s own claims management system, so that your claim can be checked and progressed. Before the check, the system normally looks for an existing claim using your name, email address, mobile number and address, so that the same claim is not checked twice. Any service provider that hosts the system for Consumer Reclaim acts only on its instructions.
Identity check and soft credit search
After you sign, Viewthru carries out a soft credit search about you with the credit reference agency Equifax Limited, to confirm who you are and to find your car finance agreements. The results are shared with Consumer Reclaim Ltd. Viewthru is a trading name of TAL Marketing Group Ltd.
To run the check, our form sends Consumer Reclaim’s system your title, name, date of birth, address, email address and mobile number, with your signature, your IP address, your browser details, the session code from the device check below and our claim reference. Consumer Reclaim shares your title, name, address and date of birth with Viewthru for the search. A soft search does not affect your credit score, and other lenders cannot see it.
As part of checking that you can make the claim, your IP address and/or mobile phone location data may be used to confirm that you are in the United Kingdom. These results are also shared with Consumer Reclaim Ltd.
Sometimes the check needs more proof that it is you. A one-time code is then sent to you by text message, to the mobile number you gave, and our form asks you to type it in. Your claim is kept while you do this.
Viewthru gets credit report information from credit reference agencies, which may include Equifax Limited and TransUnion. How the credit reference agencies use and share personal data is explained in the Credit Reference Agency Information Notice (CRAIN), published at equifax.co.uk/privacy-hub/crain and transunion.co.uk/crain. Viewthru explains how it uses your data, and how to contact it, in its privacy policy.
You give your consent to these checks when you sign. You can withdraw it at any time by contacting Viewthru or by emailing [email protected]. This does not affect checks made before you withdrew it.
The device check
When you start a claim, our claim form runs a device check from Kount, a fraud-prevention company that is part of Equifax. It helps detect and prevent fraud, including identity fraud. Your browser loads Kount’s script from jsDelivr, a public content delivery network, which receives your IP address and browser details when your browser fetches it. The check then reads technical details about your browser and device and sends them to Kount, with your IP address. Our form creates a session code for the check and sends the same code with your claim, so that the identity check can use the result. Kount may also use this information to help spot fraud on other websites and services that use Kount. Our Cookie Policy lists what the check stores in your browser.
Firms that may assess and progress your claim
In some circumstances, we will pass your case to a claims management company / solicitors and we will receive a referral fee. Where appropriate, your information and details of any relevant motor finance agreements may be shared with these firms, so that your enquiry or potential claim can be assessed and progressed:
- Bluelion Law Limited
- MR Consumer Services Limited, trading as Mis-sold Expert
- Sentinel Legal Limited
- AX-Ai Ltd
The box on our form about sharing your details names these firms, and you must tick it to go ahead. If one of these firms uses your data for its own purposes, it is responsible for that use, and it must give you its own privacy notice.
Others involved in your claim
- Your lenders and car finance brokers. We send them your letter of authority and the details they need to find your agreements and deal with your complaint.
- The Financial Ombudsman Service, if your complaint is referred to it.
- Other claims management companies or solicitors, including the firms named above, and barristers or experts, if your claim needs them. Our Terms and our Fees page explain referrals.
- The organisation that sent you a text message, if your claim started from its link. It receives only the link code, our claim reference, whether a claim was made and accepted, and the date and time (see section 4).
Our service providers
These organisations act only on our instructions and must keep your data secure.
- Our website and technology provider builds and runs this website for us, including its email inbox and the system that reads links from text messages.
- Hetzner Online GmbH hosts this website on servers in Nuremberg, Germany.
- Cloudflare, Inc. delivers and protects this website, and routes emails sent to [email protected]. It handles technical data such as your IP address and the pages you ask for, and the content of emails it routes.
- IDDQD Limited, trading as Ideal Postcodes, runs our address finder. Our server sends it only the postcode you type. It does not receive your IP address or any other details.
Others
- The FCA, the Information Commission (ICO), HMRC, the police, courts and other public bodies, where the law requires or allows it.
- Our professional advisers, such as lawyers and auditors, where they need it to advise us. They must keep it confidential.
- A buyer of all or part of our business, or its advisers, if we sell or reorganise our business. They must keep it confidential.
8. Where your data is stored
This website, including the details entered into our form, is hosted in Nuremberg, Germany. Our technology provider’s email inbox and its system for reading text-message links are also hosted in the European Economic Area (EEA). UK law recognises the EEA as giving personal data an adequate level of protection, so no extra safeguards are needed for these transfers.
Cloudflare runs a worldwide network, so it may handle technical data such as your IP address in other countries, including the United States. Cloudflare is certified under the UK Extension to the EU–US Data Privacy Framework (the “UK–US data bridge”). If that certification ever lapses, Cloudflare relies on standard contractual clauses.
Consumer Reclaim’s claims management system, the credit reference agencies, Kount, jsDelivr (the network your browser loads Kount’s script from) and the firms named in section 7 may hold your data in other places. Viewthru says in its privacy policy that it does not transfer personal data outside the UK or the EEA. Kount is part of Equifax and is based in the United States, so the device check’s data may be handled there.
Where your data is sent outside the UK, UK law requires it to be protected: for example, because UK law recognises the country as protecting personal data adequately, or by a safeguard such as the International Data Transfer Agreement (IDTA) or the UK Addendum to the EU standard contractual clauses.
9. How long we keep your data
- Your claim file. Our Terms say we keep your personal information for up to 10 years after our agreement with you ends. We keep it this long so we can deal with later questions, complaints or legal claims, and meet our record-keeping duties.
- If you do not sign. If you start our form but do not sign and send it, the details you typed are not saved.
- Website server logs. These record your IP address, the page you asked for, the date and time, and your browser type. They do not record the code in a text-message link or anything you type into our form. They are deleted automatically after about two months at most.
- Backups. Our backups are encrypted and replaced on a rolling basis. Data deleted from the website is gone from the backups within about five weeks.
- Your cookie choice. This is kept in your browser for 12 months (see our Cookie Policy).
- The device check’s cookie and storage. Our Cookie Policy says how long each one lasts.
- Others who receive your data. Where Viewthru, the credit reference agencies, Kount or the firms named in section 7 use your data for their own purposes, they decide how long to keep it, and their own privacy notices must tell you.
If you make a claim, your claim file is kept for up to 10 years after your agreement with Consumer Reclaim ends (Terms of Business, clause 10.5). Emails and enquiries that do not become a claim are kept only for as long as needed to deal with them.
When we no longer need your data, we delete it or make it anonymous.
10. Messages about your claim, and marketing
We will contact you about your claim by email, text message, phone or post. These are service messages, not marketing. Our Terms explain how often we update you.
If the identity check asks for a one-time code, the code is sent to you by text message, to the mobile number you gave. It is a service message, not marketing.
We may tell you about similar services we offer. We will only do this by email or text message where the law allows it. That means you have agreed to it. Or you became our client and, when you gave us your details, we gave you a simple way to refuse. Our claim form does not ask you to agree to marketing, so we do not send marketing by email or text message to people who claim through it unless they agree to it later. Every marketing message will tell you how to stop them. You can also opt out at any time by emailing [email protected].
We do not use your data to show you advertising on other websites.
11. Your rights
You have these rights over your personal data. Some only apply in certain situations.
- Access: you can ask for a copy of the personal data we hold about you.
- Correction: you can ask us to correct data that is wrong or incomplete.
- Erasure: you can ask us to delete your data. We may need to keep some of it, for example to meet our legal duties.
- Restriction: you can ask us to limit how we use your data, for example while we check it is accurate.
- Portability: you can ask for data you gave us in a format that can be moved to another organisation.
- Objection: you can object to us using your data based on our legitimate interests. You can object to direct marketing at any time, and we will then stop.
- Withdrawing consent: where we rely on your consent, you can withdraw it at any time. This does not affect what we did before.
- Automated decisions: you have rights about decisions made solely by computer. We do not make such decisions (see section 6).
To use any of these rights, email [email protected] or write to us at our trading address. Tell us what you are asking for and give us enough information to identify you. We may ask for proof of identity.
There is normally no charge. We will reply within one month of receiving your request, or of receiving anything we need to confirm who you are. If your request is complex, or you have made several, we may need up to two more months. If so, we will tell you within the first month. We will make reasonable and proportionate searches for your data.
12. How to complain
If you are unhappy with how we have used your personal data, please tell us first. Email [email protected] or write to us at our trading address. We will acknowledge your complaint within 30 days, look into it and tell you the outcome.
You also have the right to complain to the Information Commission (still known as the ICO), the UK data protection regulator:
- Online: ico.org.uk/make-a-complaint
- By post: Information Commission’s Office, 4th Floor, No.3 Circle Square, 5 Hawkshaw Street, Manchester, M1 7BL
Complaints about our claims service, rather than about your data, are covered by our Complaints procedure.
13. Keeping your data secure
- Every page of this website uses an encrypted (HTTPS) connection.
- Only people who need your data for their work can access it, and they must keep it confidential.
- Our backups are encrypted.
- Our claim form runs a device check that helps prevent fraud, including identity fraud (see section 7).
- Our address finder limits how often it can be used. To do this, our server briefly keeps the times of recent look-ups against a scrambled form of the visitor’s IP address. It holds no postcode or other details, and it is cleared automatically.
- We have procedures for dealing with a suspected data breach. We will tell you and the ICO where the law requires us to.
14. Children
Our services are only for people aged 18 or over. Our form checks your date of birth and does not accept anyone under 18. We do not knowingly collect data about children.
15. Cookies
This website uses only the cookies and storage it needs to work, to remember your cookie choice and, on our claim form, to help prevent fraud. Our Cookie Policy lists them.
16. Changes to this policy
We will update this policy when how we use personal data changes. The version number and date at the top show when it last changed. If we make an important change that affects you, we will tell you by email.
17. How to contact us
For any question about this policy or your personal data:
- Email: [email protected]
- Post: Consumer Reclaim Ltd (Car Claims Check), Station House, Stamford New Road, Altrincham, WA14 1EP
If you would like this policy in another format, such as large print, please email us.
